MANDADO DE SEGURANÇA COM PEDIDO LIMINAR
em face da (entidade coatora e ou pessoa), que pode ser localizado na (endereço completo com número), bairro, CEP ——–, Cidade/UF; com fundamento no inciso LXIX, do art. 5º, da Constituição Federal e Leis n.sº 12.016/2009 e 13.105/2015, expondo e requerendo o que segue:
1. Da prioridade de tramitação processual:
Inicialmente, a impetrante informa que possui deficiência visual, requerendo a concessão do benefício de TRAMITAÇÃO PRIORITÁRIA à pessoa com deficiência, nos termos do art. 1048, §§ 1º a 4º, do Código de Processo Civil c/c art. 9º, VII, da Lei n.º13.146/2015. Para tanto, anexa laudo médico comprobatório.
Ademais, requer a Vossa Excelência, após o deferimento, que seja determinada à secretaria da Vara a devida identificação dos autos e a adoção das demais providências cabíveis para assegurar, além da prioridade na tramitação, também a concernente à execução dos atos e diligências relativos a este feito.
2. Da gratuidade da justiça:
Requer também que lhe seja deferido benefício da gratuidade da justiça, nos termos da Lei n.º1.060/1950, dos arts. 98 e 99 do Código de Processo Civil e do art. 5º, LXXIV, da Constituição Federal, pois sendo professora de educação infantil com salário aproximado de dois salários mínimos, não possui recursos financeiros suficientes para suportar custas, despesas processuais e honorários advocatícios, sem prejudicar a própria subsistência, nos termos da declaração em anexo.
3. Da ausência de resolução de demandas repetitivas:
À luz do que dispõe o art. 976 do Código de Processo Civil, vale afirmar ao Douto Julgador que o caso em tela não se trata de uma demanda repetitiva, nem configura um risco de ofensa à isonomia e nem à segurança jurídica.
4. Da audiência de conciliação/mediação:
Com fulcro no art. 319, inciso VII, do Diploma Adjetivo, a impetrante manifesta seu desinteresse na realização de audiência de autocomposição, em virtude de se tratar de direito líquido e certo.
5. Dos Fatos:
Especificam-se os fatos.
6. Do cabimento e da tempestividade do Mandado de Segurança:
Nos termos do art. 5º, LXIX, a Constituição Federal assegura ao cidadão que sofra lesão ou ameaça de lesão a direito líquido e certo em virtude de ilegalidade ou abuso de poder por ato ou omissão de autoridade pública a via jurisdicional do mandado de segurança, direito público e subjetivo de levar ao judiciário o justo reclame pela restauração da legalidade na administração do interesse público.
No presente, insurge-se contra ato autoridade coatora praticado na modalidade omissiva, traduzido na ausência de publicação do resultado da primeira fase do concurso público para Cargos Técnico-Administrativos em Educação promovido pela UFRA, executado por intermédio do CEPS/UFPA e da Comissão Organizadora do Concurso, em lista específica destinada aos candidatos com deficiência para o cargo PEDAGOGO/BELÉM, em inobservância à reserva de vagas no percentual de 10% (dez por cento) destinadas às pessoas com deficiência.
Entendendo ser cabível Mandado de Segurança, Maria Aparecida Gugel ensina:
A demonstração do pressuposto da ilegalidade do ato para a concessão da segurança decorre do princípio da legalidade (37, caput), ao qual estão subordinados os atos do administrador público. O abuso de poder, por sua vez, da má utilização do poder discricionário pelo administrador ou seja, a sua liberdade de escolha, baseada na conveniência e oportunidade, para a prática do ato administrativo. Este, deve sempre atender ao princípio da legalidade e ao interesse público.
Para os efeitos de mandado de segurança estará caracterizada a ilegalidade por lesão a direito líquido e certo do candidato portador de deficiência, contidos (ou omitidos) em editais de concurso público quando: (…) não publicar separadamente a lista geral e a lista com candidatos com deficiência; (“Pessoas com deficiência e o direito ao concurso público: reserva de cargos e empregos públicos, administração pública direta e indireta”, Goiânia: Ed. da UCG, 2006, pág. 123 e 124)
Ressalta-se ainda que o mandado de segurança é tempestivo, haja vista que a impetrante apenas foi cientificada quanto à não publicação do resultado da primeira fase do concurso em lista específica para os candidatos com deficiência em 14 de junho de 2016, quando o CEPS/UFPA juntamente com Comissão Organizadora do Concurso publicaram “COMUNICADO – Convocação para Avaliação de Títulos” na sua página eletrônica, não tendo ainda transcorrido o prazo previsto no art. 23 da Lei n.º12.016/2009.
7. Do direito líquido e certo de ser classificada em lista específica para pessoas com deficiência, permanecendo no certame e concorrendo à prova de títulos, em observância ao percentual de 10% (dez por cento) da reserva de vagas destinadas às pessoas com deficiência:
Às pessoas com deficiência é garantido o direito de se inscrever em concurso público, em igualdade de condições com os demais candidatos, para provimento de cargo cujas atribuições sejam compatíveis com a deficiência que possui, concorrendo a TODAS AS VAGAS, sendo reservado percentual de no mínimo 5% (cinco por cento) e no máximo 20% (vinte por cento) das vagas em face da classificação obtida, conforme inteligência dos arts. 37, VIII, da Constituição Federal, 37, §1º, do Decreto n.º3.298/1999 e 5º, §2º, da Lei n.º8.112/1990. No caso em tela, o Edital n.º002/2016 do concurso público para Cargos Técnico-Administrativos em Educação da UFRA, realizado pelo CEPS/UFPA, destinou 10% (dez por cento) das vagas para pessoas com deficiência.
Entretanto, é evidente a violação ao referido percentual de reserva de vagas para pessoas com deficiência, pois o edital inaugural do certame apresenta CONTRADIÇÃO INSUPERÁVEL concretizada a quando da convocação para a prova de títulos:
a) de um lado, prevê o percentual de 10% (dez por cento) das vagas reservadas para candidatos com deficiência (subitem 3.4.2) e assegura as inscrições de pessoas com deficiência para concorrer a todos os cargos, inclusive àqueles cargos que dispõem de apenas uma vaga destinada à ampla concorrência (subitem 3.1.9), pois, na ocasião da convocação seriam respeitados os percentuais de reserva de vagas, conforme a existência de novas vagas, no decorrer do prazo de validade do concurso, respeitando a legislação pertinente às pessoas com deficiência;
b) ao mesmo tempo, condiciona a convocação para prova de títulos à, simultaneamente, obtenção de nota mínima (subitem 5.1) e obtenção de classificação mínima na prova objetiva, restringindo-se a proporção de 20 (vinte) candidatos por vaga ofertada, obedecidos a ordem decrescente de pontuação obtida e os empates na última posição (subitem 4.7.1.1), deixando de prever a convocação de qualquer quantitativo mínimo de candidatos com deficiência mais bem colocados na prova objetiva nos cargos em que não há previsão de vaga para provimento imediato destinada exclusivamente ao candidato PCD!
Isto é, no caso específico do cargo PEDAGOGO/BELÉM para qual existem 3 (três) vagas para provimento imediato, sendo 2 (duas) destinadas à ampla concorrência e 1 (uma) reservada aos candidatos negros, o CEPS/UFPA juntamente com a Comissão Organizadora do Concurso convocaram os 40 (quarenta) candidatos mais bem colocados na concorrência geral e os 20 (vinte) candidatos negros com maior pontuação na prova objetiva para a apresentação dos títulos, além dos empatados na última colocação, DEIXANDO DE OBSERVAR O MESMO QUANTITATIVO EM RELAÇÃO AOS CANDIDATOS COM DEFICIÊNCIA, entendendo desnecessária a convocação dos candidatos PCD mais bem colocados diante da ausência de previsão de vaga destinada a pessoa com deficiência para provimento imediato no quantitativo descritivo do cargo 331 PEDAGOGO/BELÉM, ELIMINANDO-OS DE IMEDIATO DO CERTAME e tornando impossível a sua convocação futura diante do surgimento de novas vagas no decorrer do prazo de validade do concurso público.
Conforme tabela abaixo:

Parece óbvio que, embora a banca avaliadora possua o direito de limitar o número de candidatos aprovados na prova objetiva a serem convocados para a prova de títulos, nos termos do art. 13, §6º, do Decreto n.º6.944/2009, JAMAIS poderá eliminar todos os candidatos às categorias de reservas de vagas, seja referente às pessoas negras ou às pessoas com deficiência, deixando de prever percentual mínimo obrigatório de convocação para a prova de títulos a esses candidatos, INDEPENDENTE DE EXISTIR VAGA RESERVADA PARA PROVIMENTO IMEDIATO, pois há a possibilidade do surgimento de novas vagas durante o prazo de validade do concurso público que, OBRIGATORIAMENTE, deverão observar os percentuais de reserva de vagas.
O CEPS/UFPA e a Comissão Organizadora do Concurso, ao deixarem de convocar os 20 (vinte) candidatos com deficiência mais bem colocados na prova objetiva para a avaliação de títulos, do mesmo modo como fez com os candidatos a ampla concorrência e os candidatos negros, está automaticamente eliminando toda essa categoria de candidatos que poderiam compor a lista final de aprovados no concurso público a serem nomeados em caso de existência de novas vagas, no decorrer do prazo de validade do concurso, tornando a regra quanto a reserva de 10% das vagas para pessoas com deficiência vazia e desprovida de qualquer efetividade.
Destaca-se que não se questiona a exigência do subitem 5.1, quanto ao índice de aproveitamento de, no mínimo, 50% (cinquenta por cento) em Conhecimentos Básicos e 52% (cinquenta e dois por cento) em Conhecimentos Específicos para aprovação na prova objetiva, ao qual todos os candidatos deverão ser submetidos. No entanto, superado esse percentual mínimo de acerto e estando entre os 20 (vinte) candidatos PCD mais bem colocados, é cristalino o direito de seguir no certame, sendo convocado para apresentação de títulos.
Nesse sentido, o Decreto n.º3.298/1999 determina que
Art. 41. A pessoa portadora de deficiência, resguardadas as condições especiais previstas neste Decreto, participará de concurso em igualdade de condições com os demais candidatos no que concerne:
I – ao conteúdo das provas;
II – à avaliação e aos critérios de aprovação;
III – ao horário e ao local de aplicação das provas; e
IV – à nota mínima exigida para todos os demais candidatos.
Art. 42. A publicação do resultado final do concurso será feita em duas listas, contendo, a primeira, a pontuação de todos os candidatos, inclusive a dos portadores de deficiência, e a segunda, somente a pontuação destes últimos.
Verifica-se a interpretação equivocada do CEPS/UFPA e da Comissão Organizadora do Concurso quanto à aplicação do art. 42 do Decreto n.º3.298/1999. Para a banca avaliadora, os candidatos com deficiência só teriam direito à lista de classificação específica nos cargos para os quais houvesse previsão de vaga PCD de provimento imediato, como ocorreu com os cargos 301 ADMINISTRADOR/BELÉM e 201 ASSISTENTE EM ADMINISTRACAO/BELÉM que obtiveram lista de DEMANDA DE CANDIDATOS POR CARGO e lista de PONTUAÇÃO MÍNIMA POR CARGO PARA CLASSIFICAÇÃO À AVALIAÇÃO DE TÍTULOS específicas para pessoas com deficiência.
Como todos os demais cargos ofertados no certame não previam vaga para nomeação imediata de candidato PCD, a banca examinadora entendeu que esses candidatos PCD inscritos concorreriam como candidatos comuns durante todas as fases do concurso público. Obviamente, não é esse o sentido da norma.
Desde da promulgação da Constituição Federal de 1988, tem-se buscado formas de integração e promoção da dignidade das pessoas com deficiência – tão comumente estigmatizadas e excluídas do convívio social. Nesse sentido, temos a edição de sucessivos diplomas legais declaratórios de direitos, como a Lei de Política Nacional para a Integração da Pessoa Portadora de Deficiência (Lei n.º7.853/1989) e o Decreto n.º3.298/1999, a Convenção Internacional sobre os Direitos das Pessoas com Deficiência (promulgada pelo Decreto n.º6.949/2009) e a Lei Brasileira de Inclusão da Pessoa com Deficiência/ Estatuto da Pessoa com Deficiência (Lei n.º13.146/2015), citando apenas os mais importantes.
Mesmo diante de farta legislação, com evidente caráter inclusivo, há entidades como o CEPS/UFPA e a Comissão Organizadora do presente concurso que insistem em malabarismos, se valendo de interpretações restritivas duvidosas, para não aplicação da regra contida no art. 42 do Decreto n.º3.298/1999 e inobservância prática da reserva constitucional de vagas PCD, cuja finalidade é garantir o acesso das pessoas com deficiência aos cargos públicos.
A esse respeito, ensina Maria Aparecida Gugel:
Em relação aos candidatos com deficiência classificados, o órgão ou entidade responsável pelo concurso deverá observar que o resultado final será publicado em ‘duas listas’. Uma ‘lista geral’ contendo a relação de todos os candidatos classificados, e uma outra ‘lista especial’ contendo apenas a classificação dos candidatos com deficiência. (“Pessoas com deficiência e o direito ao concurso público: reserva de cargos e empregos públicos, administração pública direta e indireta”, Goiânia: Ed. da UCG, 2006, pág. 90)
Do mesmo modo, decidiu o Superior Tribunal de Justiça:
RECURSO ORDINÁRIO EM MANDADO DE SEGURANÇA – CANDIDATO PORTADOR DE DEFICIÊNCIA VISUAL PARCIAL – CONCURSO PÚBLICO PARA O CARGO DE ESCRIVÃO DA POLÍCIA CIVIL DO ESTADO DA PARAÍBA – RESERVA DE VAGA DESRESPEITADA PELA ADMINISTRAÇÃO NO TOCANTE À CLASSIFICAÇÃO GERAL DOS CANDIDATOS E À CLASSIFICAÇÃO DOS CANDIDATOS PORTADORES DE NECESSIDADES ESPECIAIS – ART. 42 DO DECRETO Nº 3.298/99 – DIREITO LÍQUIDO E CERTO – RECURSO PROVIDO. 1. A reserva de vagas aos portadores de necessidades especiais, em concursos públicos, é prescrita pelo art. 37, VIII, CR/88, regulamentado pela Lei nº 7.853/89 e, esta, pelos Decretos nºs 3.298/99 e 5.296/2004. 2. Segundo o Decreto nº 3.298/99, os concursos públicos devem reservar 5% das vagas aos portadores de necessidades especiais. 3. Nos termos do art. 42 do mesmo decreto, a Administração, ao promover a classificação dos portadores de necessidades especiais, deve-a realizar segundo a classificação geral e, depois, segundo a classificação apenas dos portadores de deficiência. 4. Recurso ordinário provido.

Também entendendo a necessidade de observar lista de classificação geral e lista específica para pessoas com deficiência:
ADMINISTRATIVO. CONCURSO PÚBLICO. DUAS VAGAS DISPONÍVEIS. RESERVA DE VAGAS PARA PORTADORES DE DEFICIÊNCIA. ART. 37, VIII DA CF/88. DECRETO N. 3.298/99. CANDIDATO APROVADO NA CLASSIFICAÇÃO GERAL EM SEGUNDO LUGAR. PRETERIÇÃO. INEXISTÊNCIA. SENTENÇA MANTIDA. I. A Constituição Federal, em seu artigo 37, VIII, resguarda o direito de o portador de deficiência ingressar no serviço público, prevendo a reserva de vagas. II. Consoante determina o artigo 42 do Decreto n. 3.298/99, a publicação do resultado final do concurso será feita em duas listas, contendo, a primeira, a pontuação de todos os candidatos, inclusive a dos portadores de deficiência, e a segunda, somente a pontuação destes últimos. III. Conjugando-se a imposição da reserva legal de vagas com a obrigatoriedade de listagem própria, conclui-se que os deficientes participam do concurso de maneira diferenciada, seguindo as mesmas regras, sendo que os portadores de deficiência concorrem às vagas que lhe são reservadas. E para que a reserva seja efetivamente cumprida, no momento da nomeação devem ser chamados, alternada e proporcionalmente, os candidatos das duas listas, até o preenchimento total das vagas. IV. Havendo candidato aprovada em primeiro lugar na lista de classificação geral e candidato aprovado na lista de portadores de deficiência, correto o ato praticado pela Administração quando da nomeação de ambos os candidatos, ainda que se trate de apenas duas vagas (arredondamento). V. A exigência constitucional de reserva de vagas para portadores de deficiência em concurso público se impõe ainda que o percentual legalmente previsto seja inferior a um, hipótese em que a fração deve ser arredondada. Entendimento que garante a eficácia do artigo 37, inciso VIII, da Constituição Federal, que, caso contrário, restaria violado (RE n. 227.299-1/MG, Pleno, unânime, relator Ministro Ilmar Galvão, DJ 06.10.2000). VI. Entendimento que se segue, apesar de outra decisão da mesma Excelsa Corte, de relatoria do Min. Março Aurélio, que, por maioria, abandonou a tese de arredondamento de fração, se 20% não alcançar uma unidade (MS 26.310-5/DF). VII – Apelação do impetrante não provida.

8. Da concessão liminar da tutela de urgência:
O direito à tutela antecipada está compreendido no direito fundamental à tutela jurisdicional adequada e efetiva, à luz do artigo 5º, inciso XXXV, da Constituição Federal de 1988.
Os arts. 300 e 301 do Código de Processo Civil dispõem que “A tutela de urgência será concedida quando houver elementos que evidenciem a probabilidade do direito e o perigo de dano ou o risco ao resultado útil do processo”e “A tutela de urgência de natureza cautelar pode ser efetivada mediante arresto, sequestro, arrolamento de bens, registro de protesto contra alienação de bem e qualquer outra medida idônea para asseguração do direito”, consistindo em instrumentos pensados pelo legislador infraconstitucional para proteção do direito violado, havendo fundado receio de dano irreparável ou de difícil reparação.
No presente caso, a antecipação dos efeitos da tutela pretendida se faz imperiosa e urgente, pois o certame segue o andamento regular e a candidata JÉSSICA RODRIGUES SANTOS está impedida de participar da prova de títulos, tendo sido eliminada do concurso público, que até o provimento final desse writ já poderá ter sido homologado, tornando a presente ação inócua para a prevenção de prejuízos à pessoa com deficiência.
De outro modo, demonstra-se a relevância dos fundamentos jurídicos, pelas normas acima transcritas, assim como pela omissão da Administração Pública Federal em cumprir seu dever constitucional e legal de garantir o acesso das pessoas com deficiência aos cargos públicos, por meio de concurso público, já que se omite em publicar o resultado da primeira fase do concurso público para Cargos Técnico-Administrativos em Educação promovido pela UFRA, executado por intermédio do CEPS/UFPA e da Comissão Organizadora do Concurso, em lista específica destinada aos candidatos com deficiência para o cargo PEDAGOGO/BELÉM, em inobservância à reserva de vagas no percentual de 10% (dez por cento) destinadas às pessoas com deficiência.
Sendo assim, presentes os pressupostos e requisitos para a antecipação da tutela, requer seja ordenado aos impetrados que no prazo máximo de 10 (dez) dias torne pública as notas atribuídas na prova objetiva a todos os candidatos ao cargo PEDAGOGO/BELÉM e a disponibilização de consulta individual ao espelho do Cartão-Resposta da candidata JESSICA RODRIGUES SANTOS, disponibilizando o resultado dos candidatos aprovados e classificados para a etapa da prova de títulos em lista geral (o que já foi feito) e em lista específica exclusiva dos candidatos com deficiência para o cargo PEDAGOGO/BELÉM, especificando nova data para apresentação dos documentos relativos à avaliação dos títulos dos candidatos com deficiência. Requer-se ainda a imediata paralisação das avaliações de títulos em andamento, visando resguardar os direitos da impetrante.
9. Dos pedidos finais:
Diante de todo o exposto, requer:
1. O recebimento do presente mandado de segurança e a citação dos impetrados na forma da lei;
2. O deferimento da gratuidade de justiça e da tramitação processual prioritária;
3. A concessão da tutela de urgência, ordenando aos impetrados que no prazo máximo de 10 (dez) dias torne pública as notas atribuídas na prova objetiva a todos os candidatos ao cargo PEDAGOGO/BELÉM e a disponibilização de consulta individual ao espelho do Cartão-Resposta da candidata JÉSSICA RODRIGUES SANTOS, disponibilizando o resultado dos candidatos aprovados e classificados para a etapa da prova de títulos em lista geral (o que já foi feito) e em lista específica exclusiva dos candidatos com deficiência para o cargo PEDAGOGO/BELÉM, especificando nova data para apresentação dos documentos relativos à avaliação dos títulos dos candidatos com deficiência, além da imediata paralisação das avaliações de títulos em andamento, visando resguardar os direitos da impetrante;
4. A confirmação da medida liminar acima requerida, de modo que se torne definitiva, procedendo-se ao julgamento antecipado do mérito, com fulcro no art. 355, I, do Código de Processo Civil, sendo a ação julgada totalmente procedente, condenando os impetrados a respeitar a legislação específica, no sentido de publicar os resultados em separado da concorrência geral e da concorrência específica às pessoas com deficiência em todas as fases do concurso, inclusive, respeitando o percentual mínimo de 10% (dez por cento) das vagas em ocasião do resultado final, notadamente em relação à impetrante;
5. A cominação a cada um dos impetrados de multa no valor de R$ 5.000,00 (cinco mil reais), por dia de atraso no cumprimento da decisão liminar, conforme previsão contida no art. 301 do Código de Processo Civil, a ser revertida em favor da impetrante, sem prejuízo de outras providências tendentes ao cumprimento da ordem judicial;
6. Provar o alegado por todos os meios de prova admitidos em direito, sobretudo pela juntada de documentos, além da oitiva de testemunhas, peritos, médicos e da própria paciente, caso necessário.
Dá-se à causa o valor de R$ 50.000,00 (cinquenta mil reais), para efeitos fiscais, embora absolutamente inestimável o objeto tutelado.
