AÇÃO ANULATÓRIA DE DÉBITO CUMULADA COM INDENIZAÇÃO POR DANOS MORAIS E PEDIDO DE ANTECIPAÇÃO DE TUTELA

Em face de CENTRAIS ELETRICAS DO PARÁ S/A – CELPA, pessoa jurídica de direito privado, inscrita no CNPJ nº 04.895.728/0001-80 e inscrição Estadual nº 15.074.480-3, com sede na Rua Augusto Montenegro, Km 8.5, CEP:66823-010, Belém, Estado do Pará, pelas razões de fato e de direito a seguir expostas.

PRELIMINAR DE JUSTIÇA GRATUITA

A Demandante postula desde logo a concessão dos benefícios da JUSTIÇA GRATUITA, na forma da Lei Federal nº 1.060/1950 e Súmula nº 06 do Egrégio Tribunal de Justiça do Estado do Pará – TJE, por não possuir recursos suficientes para pagar às custas judiciais do processo, sem prejuízo do próprio sustento e de sua família, uma vez que a renda da família junto com a do seu companheiro já quase não suportam todas as despesas relativas ao sustento familiar, aí incluído cartão de crédito, financiamentos, conta de energia, tarifa de água, condomínio, supermercado, plano de saúde, dentre outros.
Nos termos da Lei Federal n° 1.060/50, a simples afirmação da parte no sentido de que não está em condições de pagar às custas do processo e os honorários de advogado, sem prejuízo do sustento próprio e da respectiva família, é suficiente para o deferimento da Justiça Gratuita, consoante o art. 4° do referido Diploma Legal, que dispõe:

Art. 4º A parte gozará dos benefícios da assistência judiciária, mediante simples afirmação, na própria petição inicial, de que não está em condições de pagar as custas do processo e os honorários de advogado, sem prejuízo próprio ou de sua família.
§ 1º. Presume-se pobre, até prova em contrário, quem afirmar essa condição nos termos desta lei, sob pena de pagamento até o décuplo das custas judiciais.

Trata-se de presunção legal juris tantum de hipossuficiência no sentido de não poder a parte arcar com ônus da tramitação do processo, no caso do feito se delongar e se fizer necessário a interposição de recursos e demais instrumentos processuais.
Nesse sentido, tem entendimento uníssono a jurisprudência da Corte Superior, a seguir transcrita:

Ementa: PROCESSUAL CIVIL. AGRAVO REGIMENTAL NO AGRAVO EM RECURSO ESPECIAL. BENEFÍCIO. JUSTIÇA GRATUITA. DECLARAÇÃO DE POBREZA. PRESUNÇÃO RELATIVA. REEXAME DE MATÉRIA FÁTICA. IMPOSSIBILIDADE. SÚMULA 7/STJ. AGRAVO NÃO PROVIDO. 1. Para fins de concessão do benefício da justiça gratuita em favor das pessoas naturais, basta “a simples afirmação de se tratar de pessoa necessitada, porque presumida, juris tantum, a condição de pobreza, nos termos do artigo 4º da Lei nº 1.060/50” (EREsp 1.055.037/MG, Rel. Min. HAMILTON CARVALHIDO, Corte Especial, DJe 14/9/09). 2. No caso, após a análise das condições objetivas para o enquadramento da hipossuficiência processual, entendeu o Tribunal de origem pelo indeferimento do benefício ao agravante. Assim, rever tal entendimento encontraria óbice no verbete
sumular 7/STJ. 3. Agravo regimental não provido. (AgRg no AREsp 326.132/RJ, Rel. Ministro ARNALDO ESTEVES LIMA, PRIMEIRA TURMA, julgado em 25/06/2013, DJe 02/08/2013)

Nesse diapasão segue a Súmula nº 06 do TJE/PA (Res. 003/2012 – DJ. Nº 5014/2012, 24/04/2012):

Enunciado:Para a concessão dos benefícios da justiça gratuita basta uma simples afirmação da parte declarando não poder arcar com as custas processuais, tendo em vista a penalidade para a assertiva falsa está prevista na própria legislação que trata da matéria.

Ademais, é imperioso ressaltar que o Advogado da Demandante está atuando pro bono, ou seja, sem cobrar ou receber qualquer valor a título de honorários contratuais.
Nesse sentido, tem se manifestado majoritariamente a jurisprudência do Superior Tribunal de Justiça que abaixo se colaciona:

Ementa: PROCESSO CIVIL. ASSISTÊNCIA JUDICIÁRIA GRATUITA. ADVOGADO PARTICULAR.
CONTRATAÇÃO PELA PARTE. HONORÁRIOS ADVOCATÍCIOS AD EXITO. VERBA DEVIDA. DISPOSITIVOS LEGAIS ANALISADOS: ARTS. 1º, IV, 5º, XXXV E LXXIV, DA CF/88, 3º, V, 4º E 12 DA LEI Nº 1.060/50; E 22 DA LEI Nº 8.906/94. 1. Ação ajuizada em 16.10.2009. Recurso especial concluso ao gabinete da Relatora em 04.10.2013. 2. Recurso especial em que se discute se a assistência judiciária gratuita isenta o beneficiário do pagamento dos honorários advocatícios contratuais. 3. Nada impede a parte de obter os benefícios da assistência judiciária e ser representada por advogado particular que indique, hipótese em que, havendo a celebração de contrato com previsão de pagamento de honorários ad êxito, estes serão devidos, independentemente da sua situação econômica ser modificada pelo resultado final da ação, não se aplicando a isenção prevista no art. 3º, V, da Lei nº 1.060/50, presumindo-se que a esta renunciou. 4. Recurso especial provido. (REsp 1404556/RS, Rel. Ministra NANCY ANDRIGHI, TERCEIRA TURMA, julgado em 10/06/2014, DJe 01/08/2014)

Ante os fundamentos acima consignados, e considerando o rendimento mensal da Demandante, resta cristalino que o pagamento das custas processuais consumiria quase toda a renda de seu companheiro, ocasionando o não adimplemento das despesas ordinárias da família.
Assim, pugna a Impetrante pelos benefícios da Justiça Gratuita, por ser medida de direito e justiça.

DOS FATOS

Registra-se que a titular da UC 354872 passou a ser moradora no imóvel/endereço sob questão em janeiro de 2015, honrando desde então com todas as obrigações derivativas do consumo perante a empresa ré. Ocorre que a partir da fatura referente ao mês de outubro/2016, os valores das contas da Demandante mais que triplicaram, como demonstram os arquivos acostados com as contas de outubro de 2016, novembro de 2016, dezembro de 2016 e maio de 2017.
Prontamente, a autora procurou a empresa ré para saber a origem de tal aumento, averiguando até se não possuía alguma ligação ilegal em sua corrente elétrica, o que foi posto como negativo pela própria empresa ré, como demonstra documento acostado ao processo. Restando então que a consumidora assumisse o aumento da conta sem reclamar, visto que as idas e vindas diversas vezes à sede da empresa ré, foram infrutíferas.
Impressionada com o informado e ciente da impossibilidade de consumo absurdo cobrado, até porque a autora sequer possui itens que geram grande consumo, seja pela quantidade, seja pela própria natureza dos bens que guarnecem o local, bem como, pelo pouco tempo que lá passa e pelo próprio tempo de moradia, optou por não formalizar o acordo para parcelamento de débito, buscando assim maiores orientações. Diante disso, a demandante providenciou a contestação administrativa, a qual foi indeferida, sendo que sequer teve acesso ao parecer, bem como, solicitou inspeção técnica para vistoria do local, o que nunca ocorreu, sendo que novamente quando retornou à sede da empresa ré, as atendentes afirmaram que era melhor a Demandante procurar seus direitos na justiça, pois ali não iria solucionar nada. Os protocolos anexos atestam o sobredito.
Aclara-se que a autora jamais teve notícia de que houve ou havia alguma intervenção no medidor, nunca nada lhe foi destacado como irregular. Oportunamente, por cautela, a autora destaca que não se opõe ao pagamento de possíveis diferenças havidas por faturas anteriores, porém, desde que sigam critérios de razoabilidade e proporcionalidade, até porque, sempre cumpriu com suas obrigações, não se esquivou do adimplemento das faturas cobradas pela concessionária dos serviços de energia e jamais mexeu ou permitiu que estranhos interviessem no medidor, portanto, se há ou houve algum defeito na medição, este só poderá ter responsabilidade destinada ao real infrator, evidentemente diverso da postulante.
Assevera-se ainda, que a empresa ré efetuou corte ilegal na residência da Demandante, além de colocar em débito valores que não poderiam ser acessados pelo site normal da empresa ré, somente indo diretamente á empresa e pedindo para ver os valores anexados ao seu CPF, como comprovam arquivos em anexo.
Assim, inconformada com os procedimentos da empresa Ré, com a COBRANÇA INDEVIDA do altíssimo valor gerado das faturas e com o receio de ter seu fornecimento de energia interrompido, a AUTORA não teve alternativa diversa senão buscar a via judicial para dirimir tal situação, pelo que requer a concessão da tutela antecipada no sentido de não ser negativada, impedir feitos de suspensão do fornecimento de energia, além disso, cancelar cobrança das faturas referente aos meses 10, 11, 12/2016 e 05/2017 no valor de R$ 390,91 (trezentos e noventa reais e noventa e um centavos), R$ 359,57 (trezentos e cinquenta e nove reais e cinquenta e sete centavos), R$ 359,57 (trezentos e cinquenta e nove reais e cinquenta e sete centavos) e R$ 718,32 (setecentos e dezoito reais e trinta e dois centavos), respectivamente; também cancelar a cobrança do valor que está anexo ao CPF da Demandante no valor de R$ 553,55 (Quinhentos e Cinquenta e Três Reais e Cinquenta e Cinco Centavos) e finalmente, a suposta dívida no montante da Demandante no valor de R$ 2510,78 (dois mil quinhentos e dez reais e setenta e oito centavos), sob pena de multa diária a ser imposta por este Meritíssimo Juízo.

DO DIREITO

A priori, necessário demonstrar que a proteção ao Direito da Autora está abrigado em nossa Constituição Federal, consubstanciado no inciso XXXII do artigo 5°, in verbis: “ O Estado promoverá na forma da Lei, a defesa do consumidor.”

A Autora é consumidor nos termos do Artigo 2° do Código de Defesa do Consumidor – CDC:

“Artigo 2°: o consumidor é toda pessoa física ou jurídica que adquire ou utiliza produto ou serviço como destinatário final.”

De outro lado, a Ré é fornecedora conforme expõe o Artigo 3° do CDC:

“Artigo 3°: Fornecedor é toda pessoa física ou jurídica, pública ou privada, nacional ou estrangeira, bem como os entes despersonalizados que desenvolvem atividades de produção, montagem, criação, construção, transformação, importação, exportação, distribuição ou comercialização de produtos ou prestação de serviços.”

Aclara-se que as instituições fornecedoras de serviço de energia elétrica também figuram no rol das prestadoras de serviço o Código de Defesa do Consumidor, e assim sendo, respondem de forma solidária, independente de apuração de culpa, consoante nos artigos 14 e 34 da Lei 8078/90, in verbis:

“Artigo 14: o fornecedor de serviço responde, independentemente da existência de culpa, pela reparação dos danos causados aos consumidores por defeitos relativos à prestação dos serviços, bem como por informações insuficientes ou inadequadas sobre sua fruição e riscos.”

Alerta-se que a Ré alega que houve tão somente pagamento de taxa mínima, sem ao menos ter realizado perícia técnica ou vistoria ao conhecimento da autora, já destinando cobrança de diferenças e correções retroativas, bem como, lançando sucessivos aumentos de consumo na conta de energia elétrica, ou seja, tudo ocorreu de forma unilateral e incorreta. Vê-se que tal ocorrência não se trata de prática isolada, senão vejamos exemplo ocorrido no Estado de Rondônia:

“ A Justiça de Rondônia decidiu que a perícia a ser efetivada em medidores de energia elétrica suspeitos de fraude deve operar-se por meio de órgão metrológico oficial, ou seja, pelo IPEM OU INMETRO, e nunca por ato unilateral da própria concessionária do serviço público. Para as desembargadoras da 2ª Câmara Cível do Tribunal de Justiça, é abusiva a realização de perícia por empresa terceirizada, localizada em outro estado da Federação, impondo-se ao consumidor o ônus de ter que se destacar a fim de acompanhar a confecção do laudo. A decisão é decorrente do julgamento de um agravo interno em apelação cível proposto ao 2ª grau de jurisdição do judiciário de Rondônia pelas Centrais Elétrica de Rondônia (Ceron). A empresa estatal interpôs o agravo contra decisão monocrática que já havia negado seguimento ao recurso. A tentativa era mudar a condenação da Ceron, da 1ª vara cível da comarca de Colorado do Oeste. Essa sentença declarou que não existe o débito apurado em R$ 841,97 (oitocentos e quarenta e sete reais e noventa e um centavos) e condenou a Ceron ao pagamento de R$ 6.000,00 (seis mil reais) a título de indenização por danos morais.”

a) DAS PRÁTICAS ABUSIVAS

Repisa-se que a Ré não vem operando em conformidade com os princípios que regem as relações de consumo, especificadamente o da boa-fé e da transparência, explicitado no artigo 4º do Código de Defesa do Consumidor, como segue:

Art. 4º A Política Nacional das Relações de Consumo tem por objetivo o atendimento das necessidades dos consumidores, o respeito à sua dignidade, saúde e segurança, a proteção de seus interesses econômicos, a melhoria da sua qualidade de vida, bem como a transparência e harmonia das relações de consumo, atendidos os seguintes princípios:

I – reconhecimento da vulnerabilidade do consumidor no mercado de consumo;
III – harmonização dos interesses dos participantes das relações de consumo e compatibilização da proteção do consumidor com a necessidade de desenvolvimento econômico e tecnológico, de modo a viabilizar os princípios nos quais se funda a ordem econômica, sempre com base na boa-fé e equilíbrio nas relações entre consumidores e fornecedores;

O Código de Defesa do Consumidor veda de pronto no artigo 39 a ocorrência de qualquer prática abusiva. No caso em comento, a Ré violou especificadamente o inciso V, que considera prática abusiva exigir do consumidor “vantagem manifestadamente excessiva”.

“Art. 39. É vedado ao fornecedor de produtos ou serviços, dentre outras práticas abusivas:
V – exigir do consumidor vantagem manifestamente excessiva;”

Não podemos negar que a energia elétrica revela-se como um dos bens mais preciosos da humanidade, até porque figura como serviço essencial a ser prestado obrigatoriamente pelo Estado, que no caso em tela, através da concessão, repassou a responsabilidade pelo fornecimento a Ré, porém, não se desobrigou de zelar pela prestação de serviços.
Ademais, a Autora não pode ter o fornecimento de energia interrompido pelo fato de a mesma necessitar de cuidados para a realização de trabalhos e estudos com prazos específicos, confecção de projetos, o que tornam esse serviço tão essencial na sua essência. Sendo assim, a consumidora tem direito à continuidade do serviço essencial e não pode ser exposta a qualquer tipo de constrangimento ou ameaça em razão da cobrança indevida.

A doutrina de EDUARDO GABRIEL SAAD ratifica o esposado:

“é incontroverso, porém, que se trata de atividade a carga do poder público, direta ou indiretamente, que atende a necessidade vinculada ao bem estar da coletividade. Qualquer serviço prestado pelos órgãos públicos devem ser eficientes e os essenciais terão de ser ainda obrigatoriamente contínuos.”

“A lei reguladora do exercício ao direito de greve (Lei 7.783 de 28.6.89), em seu artigo 10, apresenta um rol dos serviços e atividades essenciais a cargo de particulares ou de órgãos públicos”.

Os ensinamentos de CELSO RUSSOMANO, na obra “Guia Russomano do Consumidor” destaca que:

“(…) é proibido cortar água, luz, gás e telefone por falta de pagamento! O Código de Defesa do Consumidor garante que os serviços públicos essenciais devem ser contínuos (artigo 22 – CPDC). Não há dívida no mundo que faça o consumidor ficar no escuro, sem água no chuveiro, gás na cozinha ou depender do orelhão. (…) por lei o fornecedor só pode cobrar dívida do usuário via ação judicial (artigo 42 – CPDC).”

A legislação ensina:

“Art.10 São considerados serviços ou atividades essenciais:

I – tratamento e abastecimento de água; produção e distribuição de energia elétrica gás e combustível “

Logo, como nenhuma outra lei específica quais seriam os serviços públicos essenciais, o diploma legal que dispõe sobre o exercício do direito de greve, define as atividades essenciais e regula o atendimento das necessidades inadiáveis da sociedade, pode e deve ser aplicado para efeito de definir o que se considera SERVIÇO PÚBLICO ESSENCIAL. E lá está a ENERGIA ELÉTRICA.
Em que pese entendimentos diferenciados, a autora não quer se valer de amparo conferido pela Constituição Federal e pelo Código de Defesa do Consumidor para inadimplir possíveis obrigações, deixando de pagar os serviços essenciais que lhe são prestados. Ao invés disso, poderá ser responsabilizada em face do não pagamento somando às consequências advindas do seu inadimplemento, mas subsidiado por irregular cobrança. Não se desconheça, porém, que há os meios permitidos pelo nosso ordenamento jurídico. Assim, caso a consumidora se torne inadimplente, merece ser acionada judicialmente, arcando com os custos de sua defesa técnica e poderá ter seus bens penhorados para pagar o débito.

O CORTE DA ENERGIA ELÉTRICA, COMO INSTRUMENTO DE PENALIDADE PELA FALTA DE PAGAMENTO, É MEIO ABUSIVO, COERCITIVO E OFENSIVO À DIGNIDADE DA PESSOA HUMANA.

O princípio da dignidade da pessoa humana e do bem estar social (artigo 1°, inciso III e artigo 193), sequencia conclusão de que o serviço de fornecimento de energia elétrica, em sendo ESSENCIAL, e de obrigatória prestação pelo Estado, não pode ser suspenso, porquanto, em sendo obrigatório, a Administração Pública não pode suprimi-lo por falta de pagamento.

A doutrina do douto Hely Lopes Meirelles destaca:

“Serviços uti singuli ou individuais são os que tem usuários determinados e utilização particular e mensurável para cada destinatário, como ocorre com o telefone, a água e a energia elétrica domiciliares. Esses serviços, desde que implantados à sua obtenção para todos os administrados que se encontrem na área de sua prestação de fornecimento, e satisfaçam as exigências regulamentares. São sempre serviços de utilização individual, facultativa e mensurável, pelo que devem ser remunerados por taxa (tributo) ou tarifa (preço público), e não por imposto.

O não pagamento desses serviços por parte do usuário tem suscitado hesitações da jurisprudência sobre a legitimidade da suspensão do seu fornecimento. Há que distinguir entre o serviço obrigatório e o facultativo. Naquele, a suspensão do fornecimento é ilegal, ois, se a administração considera essencial, impondo-se coercitivamente ao usuário (como é a ligação domiciliar à rede de esgoto e da água e a limpeza urbana), não pode suprimi-lo por falta de pagamento: (…) ocorre, ainda que, se o serviço é obrigatório, sua remuneração é por taxa (tributo) e não por tarifa (preço), e a falta de pagamento não autoriza outras sanções além de sua cobrança executiva com os gravantes legais (correção monetária, juros, multa, despesas judiciais)”.

As decisões dos Tribunais acompanham o sobredito:

DIREITO CIVIL E PROCESSUAL CIVIL. CELPE. SUSPEITA DE FRAUDE NO MEDIDOR. FATURA EMITIDA COM BASE NO CÁLCULO DO CONSUMO POR ESTIMATIVA DE CARGA. PERÍCIA UNILATERAL. SUSPENSÃO DO FORNECIMENTO DE ENERGIA ELÉTRICA. ILEGALIDADE. SÚMULA 13, DESTE EG. TJPE. PROVIMENTO. – Fatos e fundamentos utilizados pelo consumidor suficientes à identificação do pedido e da causa de pedir. – Em tal sentir, podendo-se inferir que o Apelante insurgiu-se contra o corte de energia elétrica em decorrência do arbitramento unilateral ante a suspeita de fraude, não há negar que este fato, juntamente com a inclusão do nome do consumidor nos cadastros de proteção ao crédito possuem o condão de gerar danos morais. – Provimento do apelo para declarar a inexigibilidade do débito, bem assim como para arbitrar danos morais, fixados em R$ 3.000,00. – Inversão dos ônus sucumbenciais.(TJ-PE – APL: 1251710420098170001 PE 0125171-04.2009.8.17.0001, Relator: Cândido José da Fonte Saraiva de Moraes, Data de Julgamento: 30/05/2012, 2ª Câmara Cível, Data de Publicação: 109/2012).

APELAÇÃO CÍVEL. AÇÃO DECLARATÓRIA DE INEXISTÊNCIA DE DÍVIDA C/C DANO MORAL. ENERGIA ELÉTRICA. FRAUDE NO MEDIDOR. INSPEÇÃO E PERÍCIA REALIZADAS UNILATERALMENTE PELA CONCESSIONÁRIA. CONSUMO PRESUMIDO. IMPOSSIBILIDADE DE SE EXIGIR SUPOSTO DÉBITO SOB A AMEAÇA DE SUSPENSÃO DO FORNECIMENTO DE ENERGIA. CONSTRANGIMENTO E AMEAÇA AO CONSUMIDOR. RESPONSABILIDADE PELA SUPOSTA FRAUDE NÃO COMPROVADA. NEGATIVAÇÃO INDEVIDA. DANO MORAL RECONHECIDO NA INSTÂNCIA AD QUEM. RESPONSABILIDADE CONTRATUAL. CORREÇÃO MONETÁRIA. FIXAÇÃO. DATA DA CONDENAÇÃO DEFINITIVA. JUROS DE MORA. TERMO INICIAL. CITAÇÃO. PROVIMENTO PARCIAL DO RECURSO. 1.Inexigibilidade de débito relativo à fraude do medidor de energia elétrica unilateralmente aferida. 2.Impossibilidade de promover a suspensão do fornecimento de energia elétrica com o escopo de cobrar débitos pretéritos. 3.A negativação indevida gera dano moral in re ipsa, sendo desnecessária a prova de sua ocorrência. 4.A correção monetária aplicável sobre a indenização por dano moral incide a partir da data em que a verba é fixada de forma definitiva. 5.Tratando-se de responsabilidade contratual, os juros moratórios incidem a partir da citação. 6.Dado provimento ao recurso de apelação, por unanimidade, para reconhecer a ocorrência de danos morais indenizáveis.(TJ-PE – APL: 12510420078170990 PE 0001251-04.2007.8.17.0990, Relator: Francisco Manoel Tenorio dos Santos, Data de Julgamento: 08/01/2013, 4ª Câmara Cível).

b) DO DANO MORAL

Destaca-se que a cobrança ocasionada pela parte Ré gerou constrangimento a Autora quando foram gerados boletos no valor de R$ 390,91 (trezentos e noventa reais e noventa e um centavos), R$ 359,57 (trezentos e cinquenta e nove reais e cinquenta e sete centavos), R$ 359,57 (trezentos e cinquenta e nove reais e cinquenta e sete centavos) e R$ 718,32 (setecentos e dezoito reais e trinta e dois centavos), respectivamente; valor que está anexo ao CPF da Demandante no valor de R$ 553,55 (Quinhentos e Cinquenta e Três Reais e Cinquenta e Cinco Centavos) e finalmente, a suposta dívida no montante da Demandante no valor de R$ 2510,78 (dois mil quinhentos e dez reais e setenta e oito centavos), informando que o não parcelamento ou pagamento de débitos implicaria na incidência de juros, multas e poderia até mesmo ensejar na suspensão do fornecimento da energia elétrica, estando inclusive sujeita à negativação junto aos órgão de proteção ao crédito (SPC/SERASA).
A cobrança gerada foi uma surpresa para a Autora, isto porque, nunca teve seu serviço de energia elétrico interrompido por inadimplência, com a iminência de corte, bem como com a negativação do seu nome no cadastro de inadimplentes.
O doutrinador Minozzi, este italiano, defende a tese da ressarcibilidade, “Dano Moral é a dor, o espano, a emoção, a vergonha, a aflição física ou moral, em geral uma dolosa sensação provada pela pessoa atribuindo à palavra dor o mais largo significado”.
Nesse sentido, os tribunais têm entendido que é suficiente para gerar o dano moral a imputação ao consumidor do cometimento de fraude sem a devida comprovação, sem oportunizar a ampla defesa e o contraditório ainda persistindo sinais da coação ao consumidor para assinar o termo de confissão de dívida sob a cominação de ter sua energia elétrica desligada.
Colacionam-se algumas decisões nesse sentido:

APELAÇÃO CÍVEL. DIREITO PRIVADO NÃO ESPECIFICADO. AÇÃO DECLARATÓRIA DE INEXISTÊNCIA DE DÉBITO. COBRANÇA EM FACE DE SUPOSTA FRAUDE NO MEDIDOR. AUSÊNCIA DE PROVA CABAL DA ALEGADA FRAUDE NO MEDIDOR CAPAZ DE INDUZIR À RECUPERAÇÃO DE FATURAMENTO. No caso concreto, o equipamento não foi submetido à perícia técnica, não podendo a alegação de variação de consumo de energia elétrica, por si só, ensejar a cobrança a título de recuperação de consumo. REPETIÇÃO DE INDÉBITO EM DOBRO, FORTE NO ART. 42 DO CDC. UNÂNIME. APELO PROVIDO. PRESTAÇÃO DE SERVIÇOS DE FORNECIMENTO DE ENERGIA ELÉTRICA – Ação declaratória de inexigibilidade de débito c.c. indenização por danos morais Suspensão do fornecimento de eletricidade pela ré após apuração de violação do medidor de consumo, com lavratura de Termo de Ocorrência de Irregularidade (TOI) – Inexistência de demonstração inequívoca, pela ré, de que de fato houve fraude, sendo o TOI prova unilateral Ausência de perícia judicial – Impossibilidade de corte no fornecimento de eletricidade e da cobrança do montante pretendido pela concessionária – Necessidade de restabelecimento no fornecimento de energia elétrica. DIREITO DO CONSUMIDOR E PROCESSUAL CIVIL. AGRAVO LEGAL EM AGRAVO DE INSTRUMENTO (ART. 557, § 1º, CPC). SUSPEITA DE FRAUDE EM MEDIDOR DE ENERGIA ELÉTRICA. DIFERENÇA DE CONSUMO APURADO POR PERÍCIA UNILATERAL PELO CRITÉRIO DE ESTIMATIVA DE CARGAS. COBRANÇA INDEVIDA. MEDIDA COERCITIVA. DESCONSTITUIÇÃO DO DÉBITO. DANOS MORAIS. RECURSO IMPROVIDO. – Havendo suspeita de fraude nos medidores não é possível à concessionária fixar unilateralmente o valor supostamente devido, exigindo-o sob a ameaça de interrupção do fornecimento; – Não há razoabilidade na aferição do consumo de energia elétrica em uma residência considerando, abstratamente, a potencialidade de consumo de todos os equipamentos elétricos nela instalados, posto que o consumo efetivo não decorre da simples existência dos bens; – O arbitramento simplesmente ignora tal fato e desconsidera qualquer variação dos níveis de consumo de energia numa residência ao longo do ano, conforme se encontre nesta ou naquela estação, em período de férias ou de viagem prolongada, dentre outras intercorrências; – O exame realizado unilateralmente é insuficiente para respaldar a legalidade da cobrança realizada que deve ser feita como o fazem todos os credores comuns, mediante processo judicial com as garantias do contraditório e da ampla defesa; – Constrangimento do consumidor submetido à cobrança para evitar a suspensão do fornecimento e agravar os danos à sua personalidade; – Desconstituição do débito e do parcelamento, com a repetição simples ao consumidor das quantias já pagas, acrescidas de juros legais e corrigidas monetariamente desde a data do pagamento, considerando que o parcelamento não foi integralmente quitado; – Mantida indenização por danos morais fixada em R$ 500,00 (quinhentos reais).(TJ-PE – AGV: 2440615 PE 0015242-68.2011.8.17.0000, Relator: Cândido José da Fonte Saraiva de Moraes, Data de Julgamento: 15/09/2011, 2ª Câmara Cível, Data de Publicação: 178)

Com efeito, intentando aplicação da razoabilidade e a proporcionalidade do dano moral causado pela Ré, requer a Vossa Excelência que fixe a indenização por dano moral no valor de R$ 25.000,00 (vinte e cinco mil reais), em favor da Autora.

DA TUTELA ANTECIPADA

O Código de Processo Civil em seu art. 300, determina:

“Artigo 300. A tutela de urgência será concedida quando houver elementos que evidenciem a probabilidade do direito e o perigo de dano ou o risco ao resultado útil do processo.

A prova inequívoca da verossimilhança das alegações fica demonstrada com o histórico de consumo juntado aos autos e comprovantes de pagamento das faturas anteriores, os quais comprovam que inexistia irregularidade evidente na UC da Autora, portanto, entende que as faturas emitidas e o valor de R$ 390,91 (trezentos e noventa reais e noventa e um centavos), R$ 359,57 (trezentos e cinquenta e nove reais e cinquenta e sete centavos), R$ 359,57 (trezentos e cinquenta e nove reais e cinquenta e sete centavos) e R$ 718,32 (setecentos e dezoito reais e trinta e dois centavos), respectivamente; valor que está anexo ao CPF da Demandante no valor de R$ 553,55 (Quinhentos e Cinquenta e Três Reais e Cinquenta e Cinco Centavos) e finalmente, a suposta dívida no montante da Demandante no valor de R$ 2510,78 (dois mil quinhentos e dez reais e setenta e oito centavos), são indevidos.
Sendo assim, diante do fundado receio em ter seu fornecimento de energia elétrico suspenso, requer a concessão da antecipação da tutela para que a requerida se abstenha de negativar o Titular da UC nos cadastros de inadimplentes e suspender o fornecimento de energia elétrica da Autora, bem como, cancele as cobranças das faturas geradas dos meses de outubro, novembro, dezembro de 2016 e maio de 2017.

DOS PEDIDOS

Diante do exposto, pede e requer a Vossa Excelência:

A concessão da tutela antecipada com o intuito de não negativar a Titular da UC nos cadastros de inadimplentes, não suspender o fornecimento da energia elétrica da autora, bem como, cancele as cobranças das faturas geradas dos meses de outubro, novembro e dezembro de 2016 e maio de 2017, sob pena de multa diária a ser fixada pelo douto juízo;
Determinar a citação da CENTRAIS ELÉTRICAS DO PARÁ S.A., na pessoa de seu representante legal, para querendo, contestar o presente feito, no prazo da lei, e o acompanharem até o seu final, sob pena de arcarem com o ônus da revelia;
Julgar procedente o pedido contido na presente ação para declarar inexistente o débito advindo da fatura do mês de outubro/2016 – R$ 390,91 (trezentos e noventa reais e noventa e um centavos), novembro/2016 – R$ 359,57 (trezentos e cinquenta e nove reais e cinquenta e sete centavos), dezembro/2016 – R$ 359,57 (trezentos e cinquenta e nove reais e cinquenta e sete centavos) e de maio/2017 – R$ 718,32 (setecentos e dezoito reais e trinta e dois centavos); também cancelar a cobrança do valor que está anexo ao CPF da Demandante no valor de R$ 553,55 (Quinhentos e Cinquenta e Três Reais e Cinquenta e Cinco Centavos) e finalmente, declarar inexistente o débito o qual a empresa ré se julga credora no montante da Demandante no valor de R$ 2510,78 (dois mil quinhentos e dez reais e setenta e oito centavos), além da devolução em dobro dos valores cobrados, considerando que a cobrança é indevida;
Aplicação da inversão do ônus da prova;
Julgar procedente o pedido de indenização por danos morais no valor de R$ 25.000,00 (vinte e cinco mil reais), custas e honorários advocatícios.
Protesto provar o alegado por todos os meios de prova em direito admitidos.
Dá-se a causa o valor de R$ 34.785,40 (trinta e quatro mil, setecentos e oitenta e cinco reais e quarenta centavos).

Pede Deferimento.
